Terms of Service

1. Acceptance of Terms

By accessing or using the Zenfinity website (joinzenfinity.com), mobile application, or any services provided by Easy Controls LLC ("Zenfinity," "Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

Easy Controls LLC is a Florida limited liability company managed by Joe Lisi, Managing Member.

2. Eligibility

  1. You must be at least 18 years of age or the age of majority in your jurisdiction to use Zenfinity.
  2. By using our services, you represent that you meet the eligibility requirements and have the legal capacity to enter into a binding agreement.

3. Account Creation

  1. To access certain features and make purchases, you must create an account. Account authentication is handled through Firebase Authentication, supporting email/password, Apple Sign-In, and Google Sign-In.
  2. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  3. You agree to provide accurate, current, and complete information during registration and to update your information as necessary.
  4. You must notify us immediately of any unauthorized use of your account.
  5. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Purchases and Payments

  1. Zenfinity offers digital fitness programs and related content available for purchase through our website.
  2. All payments are processed securely through Stripe. We do not store your payment card details on our servers.
  3. Prices for programs are displayed at checkout and are charged as one-time payments unless otherwise stated.
  4. All prices are listed in US dollars unless otherwise indicated.
  5. You agree to pay all charges incurred through your account at the prices in effect when the charges are incurred.
  6. By completing a purchase, you authorize us to charge the payment method you provide for the total amount of your order.

5. Digital Content Delivery

  1. After a successful purchase, the program you bought is unlocked and delivered within the Zenfinity mobile app.
  2. You must have the Zenfinity app installed and be signed into the same account used for the purchase to access your program.
  3. Programs are delivered digitally and are available immediately after payment is confirmed.
  4. We reserve the right to update, modify, or improve program content at any time to enhance the user experience.

6. Refund Policy

Our full Refund Policy is available at /legal/refund-policy. By making a purchase, you acknowledge and agree to the terms of our Refund Policy.

In summary: all sales of digital products are final by default, as access is granted immediately. Exceptions may be considered for requests made within 14 days if the program has not been significantly accessed.

7. User Conduct

You agree not to:

  1. Use the service for any unlawful purpose or in violation of any applicable laws or regulations.
  2. Attempt to gain unauthorized access to any portion of the service, other accounts, or any systems or networks connected to the service.
  3. Reproduce, distribute, publicly display, or create derivative works from any content or programs without our express written permission.
  4. Share, resell, or redistribute purchased program content to third parties.
  5. Use automated means (bots, scrapers, etc.) to access the service.
  6. Interfere with or disrupt the service or servers or networks connected to the service.
  7. Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  8. Upload or transmit viruses, malware, or any other malicious code.

8. Intellectual Property

  1. All content, materials, programs, designs, logos, trademarks, and software provided through Zenfinity are the exclusive property of Easy Controls LLC or its licensors.
  2. Your purchase of a program grants you a limited, non-exclusive, non-transferable, personal license to access and use the program content for your own personal, non-commercial fitness purposes.
  3. You may not copy, modify, distribute, sell, lease, or create derivative works from any Zenfinity content.
  4. The Zenfinity name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Easy Controls LLC.

9. Privacy

Your privacy is important to us. Our Privacy Policy, which explains how we collect, use, and protect your personal information, is available at our Privacy Policy page. By using our services, you agree to the terms of our Privacy Policy.

10. Health and Fitness Disclaimers

Please read this section carefully.

  1. Zenfinity provides fitness programs and nutritional information for educational and informational purposes only. Our content is not medical advice and is not intended to diagnose, treat, cure, or prevent any disease or health condition.
  2. You should consult with a qualified healthcare professional before beginning any exercise program, nutrition plan, or making changes to your existing health regimen, especially if you have any pre-existing medical conditions, injuries, or health concerns.
  3. Results vary. Individual results depend on many factors, including but not limited to your starting fitness level, adherence to the program, genetics, diet, sleep, and other lifestyle factors. We make no guarantees regarding specific results.
  4. You assume all risk of injury that may result from participating in any exercise or fitness program provided through Zenfinity. You agree to stop any exercise immediately if you feel pain, dizziness, or discomfort.
  5. Zenfinity is not a licensed medical provider, dietitian, or healthcare practitioner. Any nutritional information provided is for general guidance only and should not replace professional dietary advice.

11. Limitation of Liability

  1. To the maximum extent permitted by applicable law, Easy Controls LLC and its members, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the service.
  2. Our total aggregate liability for any claims arising out of or related to these Terms or your use of the service shall not exceed the total amount you have paid to Zenfinity in the 12 months preceding the event giving rise to the claim.
  3. The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify, defend, and hold harmless Easy Controls LLC, its Managing Member, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to:

  1. Your use of the service.
  2. Your breach of these Terms.
  3. Your violation of any law or the rights of any third party.
  4. Any content you submit or transmit through the service.

13. Third-Party Services

Zenfinity may integrate with or contain links to third-party services, including but not limited to Stripe (payments), Firebase (authentication), and other platforms. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is governed by their respective terms and policies.

14. Modifications to Terms

  1. We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the updated Terms on our website with a revised "Last updated" date.
  2. Your continued use of the service after the effective date of any changes constitutes your acceptance of the modified Terms.
  3. If you do not agree with any modifications, you must stop using the service.

15. Termination

  1. We may suspend or terminate your access to the service at any time, with or without cause, and with or without notice.
  2. You may terminate your account at any time by contacting us at joe@joinzenfinity.com or using the account deletion feature in the app.
  3. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination (including but not limited to intellectual property, limitation of liability, indemnification, and governing law) shall continue to apply.

16. Governing Law

  1. These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.
  2. Any disputes arising under or in connection with these Terms shall be resolved in the courts of the State of Florida.
  3. Both parties agree to submit to the personal jurisdiction of the courts located in the State of Florida.

17. General Provisions

  1. Entire Agreement - These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Easy Controls LLC regarding the use of the service.
  2. Severability - If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  3. Waiver - Failure by Zenfinity to enforce any provision of these Terms shall not constitute a waiver of that provision.
  4. Assignment - You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights freely.
